The article is an interesting example of a situation I was involved in along
with my brother last year.

We were contacted by several landmen expressing an
interest in leasing our oil and gas minerals and my brother made a decision to
lease the minerals he owned. I felt that the offer was insufficient and
declined.

In further discussions I suggested that the landman's offer was
acceptable through a particular formation, but not acceptable for a lease absent
a clause limiting the depth that could be explored---a so-called "Pugh depth
clause". When the landman agreed to this, I called my brother to learn that
he had signed his lease and deposited the accompanying payment draft with his
bank was awaiting funding.

When he learned my agreement he promptly contactae
his bank and advised them not to accept funding of the draft he had given them
for collection. The bank withdrew their efforts to collect the draft and a
